Fijn and your privacy
At Fijn Holding B.V. (hereinafter: Fijn), we attach great importance to your privacy and want to inform you clearly through this privacy statement how we handle your personal data. It’s important to us that you understand how we handle your personal data. In this Privacy Statement you can read how we do that. The main principles are:
- We collect, use and store personal data. We process your data in a way that complies with laws and regulations.
- We inform you in advance about the processing of your personal data. You have the right to have your personal data corrected, supplemented, deleted or blocked if you request this.
- We process your personal data only for the purposes set out in this Privacy Statement. Personal data will only be shared if necessary or based on a legal obligation.
If we engage others to process your personal data, we inform them or agree that they may only use your data lawfully.
This Privacy Statement is divided into two parts. Depending on your situation, only one part of the Privacy Statement may apply to you. The Privacy Statement focuses on a section for tenants who rent directly from Fijn and a section for tenants who rent from another landlord who purchases EPV or monitoring from Fijn.
I am a tenant of Fijn
Fijn has developed a system for monitoring energy performance, which includes coaching tenants on energy awareness (“the Monitoring”). For the Monitoring, Fijn processes data including your personal data.
Personal data
Personal data is any data that can be directly or indirectly traced back to you as a person. For example, your name, address, date of birth, phone number, email address and account number. Everything we do with that personal data is called “processing’’. This can include collecting, storing, consulting, publishing, changing or deleting personal data. In order to execute the rental contract and Monitoring, Fijn processes the following personal data:
- Your zip code and house number
- Your name
- Your phone number
- Your email address
- Your account number
- Sensor data from the building bound systems, from which indirectly behavior, usage and routines can be derived
On what base do we process your personal data?
Fijn processes your data on the basis of one or more of the following legal bases:
- For the conclusion and performance of an agreement to which you are or wish to be a party;
- When you have given your consent.
Who we share your information with
For the purposes above, it may be necessary to exchange your personal data with other entities or with other parties. Fijn provides your personal data to these parties only for the purposes set out in this Privacy Statement. Your data will not be processed outside the European Economic Area (EEA). For example, we may exchange your personal data with:
- another business unit within Fijn Holding or the Van Wijnen Groep;
- parties that are important for the performance of our activities, such as chain partners, subcontractors and suppliers;
- regulators and other bodies required to comply with our legal obligations.
If we engage a third party to process your data, Fijn remains responsible for the protection of your personal data. We will enter into a data processing agreement with the third party that complies with the GDPR.
Fijn is neither responsible nor liable for the processing of your personal data by parties that are themselves responsible for compliance with privacy legislation. However, we do point out to them that they may only use your data lawfully.
How long do we keep your personal data?
We keep your personal data, which is necessary for the formation of the rental agreement, for up to 2 years after the expiration of the rental agreement. During this period it is possible to link the data from the sensors to you. After the data is deleted, it is no longer possible to link the personal data to the sensor data and we consider it anonymous.
I rent from a landlord for whom Fijn provides monitoring.
Monitoring
Fijn has developed a system for monitoring of the energy performance of your house, which includes coaching tenants on energy awareness ('the Monitoring'). For the Monitoring, Fijn is a Controller within the meaning of the GDPR.
This privacy statement provides information about the processing of personal data by Fijn pursuant to the Monitoring. We are responsible for processing this data carefully and in accordance with applicable privacy legislation, including the GDPR.
Energieprestatievergoeding
You have entered into an agreement with your landlord to rent your property. If EPV has been purchased for your home, the landlord will charge you a monthly amount for energy (called Energieprestatievergoeding (EPV)). The energy fee means that in exchange for the amount you pay each month, you live in a sustainable and energy-efficient home that generates its own energy through solar panels on the roof. So in addition to the rent, you also pay an energy fee to the landlord.
Data processing
We process the following data, where applicable, associated with your address:
- Sensor data from the building bound systems, from which indirectly behavior, usage and routines can be derived
- Address of the home (zip code, house number)
- Salutation, your first name or initials, middle name and last name
- Your phone number
- Your login name
- Your email address
- Password (encrypted)
Purposes of processing the above data
We use your personal data exclusively for the following purposes:
- Energieprestatievergoeding: If an energy performance guarantee has been agreed for your home, we use the data to give you the guarantee that your home is also performing as agreed. For example, we want to know how the various installations are functioning. If, for example, there are strong deviations in energy consumption, the possible cause can be found more easily.
- Dashboard: Insight for you and us into the energy performance of your rental home and the functioning of the various energy installations in your home in relation to the use of the home. Through insight into your data, we can (commission) and optimize Fijn management and maintenance services and provide you with tips.
- Advice: helping and advising you in becoming energy aware and using your Fijn home. The dashboard will be able to act as a 'digital coach' by providing insight into (for example) the current statuses of generation and consumption. You will thus gain insight into the effect of your behavior in the use of energy and thus also the annual accounts.
- For service improvement and further development, your data may be used to analyze, evaluate and improve the services provided to you. We value that you, also in the future, have access to additional products or services, which make it possible to let you save even more energy or let you live even better. These products and services have a high service character, tie in with the above points and may, for example, relate to offering more economical appliances or lighting, securing your home as well as performing additional services in the above areas.
- We may also process your data in order to deal with any other queries or complaints.
Basis of data processing
We process your personal data on the basis of one or more of the following legal bases:
- concluding and executing an agreement with you or the landlord;
- serving the legitimate interests of Fijn or third parties such as your landlord. In such a case, we always weigh your and our interests against each other. Only if we find that our legitimate interests outweigh your privacy interests will we process your personal data on this basis;
- your consent;
- compliance with legal obligations, including those for the EPV.
Provision to third parties
For the purposes above, it may be necessary to exchange your personal data with each other or with other parties. Fijn will provide your personal data to these parties only for the purposes set out in this Privacy Statement and based on the stated bases. Your data will not be processed outside the European Economic Area (EEA). For example, we may exchange your personal data with:
- Various suppliers of facilities and equipment, in terms of providing maintenance and management services to those facilities and equipment.
- Government agencies such as municipalities, tax authorities and regulators to provide fulfillment on a legal claim.
- Corporate clients and chain partners such as landlords, construction companies, contractors and subcontractors, and subsidy administrators.
- External suppliers such as ICT service providers, hosting and cloud service providers or other suppliers to whom we outsource support services, including suppliers providing technology, materials and home automation services.
External advisors such as accountants, tax advisors, lawyers and notaries.
Retention periods
We retain your personal data in accordance with the GDPR and specific mandatory legal retention periods. Data will not be kept longer than strictly necessary to achieve the purposes for which the data was collected and to comply with legal obligations.
General
Data security
We take appropriate security measures to protect your data against loss or any form of unlawful processing. For example, we ensure that only the necessary persons have access to the data, that access to the data is protected, and transmission of the data is protected by appropriate security measures. Fijn continuously takes appropriate technical and organizational measures to ensure the security of personal data. Below is a brief description of these security measures.
Fijn stores monitoring data in such a way that it cannot be directly traced back to you or your home. Only at times when this is necessary, a temporary connection is made between this data and your name and address details.
If you move out, the data is not deleted. However, all references to your person are deleted, so that the data can no longer be traced back to you. A subsequent tenant will not be able to see your data.
What are your rights?
From the moment we process your personal data, you have several rights. Those rights are stated below:
Information and inspection
You can ask us whether we process personal data about you, which it is and when we do so. We are obliged to provide you with this information.
Withdrawing your consent
If we process your data because you have consented to it and you withdraw your consent, we may not further process your data.
Correction or deletion of data
Is your personal data incorrect or incomplete? Then you can ask us to change them. You can ask us to delete your personal data when it is no longer necessary for the purpose for which we processed it. Or when you withdraw your consent or object to processing.
Restriction
You can ask us to temporarily restrict the processing of certain personal data. For example, because in your opinion the data is incorrect.
Data portability
You can ask us to transfer your personal data to another controller.
Objection
You can object to the processing of your personal data.
Submission of request
To exercise your rights, you may submit a request. You can do this by sending an e-mail to rechten@vanwijnen.nl. Within four weeks you will receive a message from us telling you what we will do with your request. If there is a legitimate reason or a legal obligation that prevents us from fulfilling your request, we will reject your request. You may submit an objection to this to Fijn Holding at rechten@vanwijnen.nl or file a complaint with the Dutch Data Protection Authority. When processing your request, we may ask you for identification. It may also be necessary to process your personal data in order to properly answer your questions.

You also have the right to file a complaint with the Autoriteit Persoonsgegevens against the processing of your personal data. Amending the Privacy Statement
We may amend this Privacy Statement. We do so, for example, if the law or our policies change. We will inform you about this via the website. You can always find the current Privacy Statement on our website.
